Court quashes decision to disbar attorney Owen Clunie, sends back case to Legal Council

The Court of Appeal has set aside a decision to disbar attorney- at- law and retired deputy Commissioner of Police Owen Clunie.

Clunie was struck from the roll of attorneys last October by the General Legal Council (GLC) after allegedly failing to pay over funds he had received from a client.

He was disbarred in September last year following a complaint by a client that he gave Clunie $600,000 to deposit on a property.

A disciplinary committee of the GLC found that the money was not paid to the vendor's lawyer and as a result, the purchaser sold the property to someone else.

Clunie subsequently appealed the ruling.

Earlier today, the Court allowed the appeal in part, quashing the decision to disbar Clunie.

The court also sent back the case to a panel of the disciplinary committee of GLC to hear submissions in mitigation and to determine the appropriate sanctions.
